1. Who we are
DiveLog is a service provided by Enea Del Lama ("we", "the provider"). By using DiveLog the user enters into a contract directly with Enea Del Lama. For any communication: support@divelogs.app.
2. Acceptance of terms
By using or registering an account on DiveLog the user declares that they have read, understood and fully accepted these Terms. If they do not accept them, they must stop using the service.
3. Service description
DiveLog is a digital scuba log book that lets you record dives, import files from your dive computer, manage centres, boats, buddies and related media. Some features are only available with a paid subscription.
4. User account
The user is responsible for keeping their credentials confidential and for all activity carried out through their account. They must provide accurate information and keep it up to date. If they register on behalf of an organisation they represent that they have authority to bind it to these Terms.
5. Permitted and prohibited use
The user agrees not to:
- use the service unlawfully, fraudulently or for spam;
- infringe the intellectual property rights of third parties or of the provider;
- interfere with service security (malware, scanning, unauthorised scraping, attempted unauthorised access);
- resell, redistribute or rent the service to third parties without authorisation;
- reverse-engineer or circumvent technical limits of the service.
6. Intellectual property
Enea Del Lama retains all rights in the software, the DiveLog brand, the documentation and the infrastructure. The user is granted a limited, non-exclusive, non-transferable licence to use the service within the plan they have chosen. The user retains ownership of the content they upload and grants the provider a limited licence to host and process it solely to deliver the service.
7. Payments, subscriptions and billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service for all inquiries relating to orders, payments, billing, tax and refunds.
Payment terms, renewal, cancellation and taxes are governed by the Paddle Buyer Terms. Subscriptions renew automatically at the end of each billing cycle (monthly or yearly) at the then-current price, unless cancelled before renewal.
8. Refunds
Refunds are governed by our Refund Policy.
9. Suspension and termination
We reserve the right to suspend or terminate the user's access in case of: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. The user may cancel their account at any time; upon termination data will remain available for export for a reasonable period and then be deleted.
10. Service level and warranties
We strive to provide the service with the utmost care but we do not warrant that it will be uninterrupted or error-free. To the maximum extent permitted by law, all implied warranties of merchantability and fitness for a particular purpose are excluded.
11. Limitation of liability
To the maximum extent permitted by law, Enea Del Lama's aggregate liability to the user is limited to the amount actually paid by the user in the 12 months preceding the triggering event. Liability for indirect, consequential or special damages (loss of profits, data, goodwill) is excluded. No exclusion or limitation applies to wilful misconduct, gross negligence, death or personal injury where these cannot be excluded by law.
12. Indemnification
The user agrees to indemnify Enea Del Lama from any third-party claim arising from content they have uploaded, unlawful use of the service or breach of these Terms.
13. Changes
We may update these Terms at any time. Significant changes will be notified via email or in-service with reasonable notice.
14. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute shall be resolved exclusively by the courts of the provider's place of residence, subject to mandatory consumer rights.
