Terms and Conditions

DiveLog is a service provided by Enea Del Lama ("we", "the provider"). By using DiveLog, you enter into a contract directly with Enea Del Lama. For any communication: support@divelogs.app.

By registering an account or continuing to use DiveLog, you declare that you have read, understood and fully accepted these Terms. If you do not accept them, you must stop using the service.

You declare that you are at least 16 years old and, if acting on behalf of a company or dive center, that you have the necessary authority to bind that organization.

DiveLog is a digital dive logbook that lets you record dives, download data from your dive computer via Bluetooth or cable, import UDDF files, manage sites, dive centers, boats, buddies, equipment and linked media, as well as technical calculators (nitrox MOD, SAC/RMV, gas planning and blending).

Some features are reserved for paid plans. The public calculators and the logbook within the limits of the free plan can be used without a subscription.

DiveLog is a recording and calculation tool provided for informational and educational purposes. It does not replace your dive computer, dive tables, the training you received, or the judgment of a qualified instructor or guide. The results produced by the calculators (MOD, gas consumption, planning and gas blending) depend on the data you enter and must always be verified before use in the water. You are solely responsible for planning and conducting your own dives.

• you are responsible for the confidentiality of your credentials and for all activity carried out through your account;
• the information you provide must be truthful, complete and kept up to date;
• any unauthorized access must be reported promptly to support@divelogs.app;
• the account is personal and may not be shared with third parties, other than through the club features provided by your plan.

You agree not to:

• use the service unlawfully, fraudulently, or for spamming purposes;
• infringe the intellectual property rights of third parties or of the provider, including by uploading photos or videos for which you do not hold the necessary rights;
• interfere with the security of the service (malware, scanning, unauthorized scraping, unauthorized access attempts, circumventing plan limits);
• resell, redistribute or rent the service to third parties without authorization;
• reverse engineer the software or the import protocols.

Upon a substantiated notice from rights holders, we may remove uploaded content and, in cases of repeated infringement, suspend the account.

Enea Del Lama remains the owner of all rights in the software, the DiveLog trademark, the documentation and the infrastructure. You are granted a limited, non-exclusive, non-transferable and revocable license to use the service within the scope of your chosen plan. You retain ownership of the content you upload and grant the provider a limited license to host, process and display it solely to provide the service and the sharing features you activate.

Paid plans are offered on a monthly or annual basis, along with any one-time purchases (lifetime licenses). Subscriptions renew automatically at the end of each cycle at the then-current price, unless cancelled before renewal.

The Pro plan may include a 14-day free trial. During the trial you have access to Pro features; if you do not cancel before the trial ends, the subscription continues as a paid subscription. If payment fails, the account reverts to the free plan and your data remains accessible within the limits of the free plan.

Prices may change: changes apply only to subsequent renewals and are communicated with reasonable advance notice.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles customer support for all inquiries related to orders, payments, invoicing, taxes and returns.

Payment terms, renewal, cancellation and taxes are governed by the Paddle Buyer Terms. Invoices and receipts are available from the Plan and Billing page of the app or via paddle.net.

Refunds are governed by our Refund Policy and processed by Paddle. You can request a refund via paddle.net or by contacting our support team.

We may suspend or terminate access in the event of a material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your account at any time: after termination, data remains exportable for a reasonable period and is then deleted or anonymized, subject to legal retention obligations.

We strive to provide the service with the utmost care, but we do not guarantee that it will be uninterrupted, always available, or error-free: maintenance, updates, or third-party provider outages may occur. To the maximum extent permitted by law, all implied warranties of merchantability and fitness for a particular purpose are excluded. We recommend keeping a copy of your most important data using the export features.

To the maximum extent permitted by law, the aggregate liability of Enea Del Lama to you is limited to the amount actually paid by you in the 12 months preceding the event giving rise to the claim. Liability for indirect, consequential or special damages (loss of profits, data or goodwill) is excluded. No exclusion or limitation applies in cases of willful misconduct, gross negligence, death or personal injury, or to mandatory consumer rights.

You agree to indemnify Enea Del Lama against any third-party claim arising from the content you upload, unlawful use of the service, or breach of these Terms.

Neither party is liable for failures caused by events beyond its reasonable control (network failures, government actions, natural disasters). You may not assign the contract without our consent; we may assign it in the event of a merger, acquisition or business transfer, without prejudice to your rights.

We may update these Terms to reflect changes to the service or to applicable law. Material changes will be communicated by email or via an in-app notice with reasonable advance notice; continued use of the service after the changes take effect constitutes acceptance.

These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the court of the provider's place of residence, subject to any mandatory jurisdiction rules protecting consumers.
